These Terms & Conditions govern the use of this website and the purchase of products from Necros Fragrance (“we,” “us,” or “our”). By accessing our website and placing an order, you agree to be bound by these Terms & Conditions.

2. Products

• All perfumes are handmade in Belgium, in compliance with EU cosmetics regulations (Regulation (EC) No 1223/2009).

• Products and any samples provided are for personal use only and may not be resold.

• Product images are for illustration purposes only. We cannot guarantee that device displays accurately represent colors.

• As products are handcrafted, slight variations in materials, colour, or finishes may occur.

• You must be at least 18 years old to purchase from this site.

3. Orders & Contract Formation

• Upon placing an order, you will receive an email acknowledging receipt and providing an order number.

• The contract between you and Necros is formed only when you receive a Dispatch Confirmation email.

• If we cannot fulfil your order after acknowledgment, we will contact you via email or telephone.

• We reserve the right to reject any order at any time, including if items are out of stock, if pricing errors occur, if payment authorization fails, or in cases of suspected fraudulent/suspicious activity.

• A product becomes your responsibility upon delivery to the provided address. Ownership passes to you once full payment is received.

4. Pre-Orders

• When items are sold out or awaiting raw materials, they may be available for pre-order.

• Payment is required in full at the time of placing a pre-order.

• Estimated delivery dates are provided as guidance only and are not guaranteed.

5. Processing & Dispatch

• Orders are crafted and prepared during the week and shipped twice weekly.

• Current estimated processing times are displayed on our website and in your order confirmation email.

• Processing and dispatch times are estimates only. Delays do not entitle customers to cancellation unless covered under EU withdrawal rights.

• You will receive a dispatch email with tracking details once your order ships.

6. Order Modifications & Cancellations

• If you wish to modify an order, please contact us immediately. We will advise if changes are possible and any impact on price or delivery.

• We reserve the right to cancel any order for reasons including:

  • Items unavailable

  • Payment processing issues

  • Invalid shipping address

  • Suspected fraud

  • Duplicate orders

  • Excessive purchase limits

  • Abusive or hostile customer behaviour

• Customers will be notified by email if an order is cancelled, and any payment refunded.

7. All Sales Are Final Policy

• All products are handcrafted to order. Once crafting begins, orders are final and cannot be cancelled.

• We do not accept returns or exchanges for reasons of preference or dissatisfaction with a scent.

• For hygiene and quality reasons, opened or used products cannot be returned under any circumstances.

• If cancellation is requested before crafting begins, we may accommodate at our discretion. Cancellation fees may apply to cover processing and admin costs.

8. Right of Withdrawal (EU Consumers)

Under EU law, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.

Exceptions:

• Due to hygiene and safety, opened or used perfumes cannot be returned.

• Discovery Sets are non-returnable.

To exercise withdrawal rights, contact us within 14 days by email.

9. Shipping

• We ship within Belgium, the EU, and internationally where regulations allow.

• Delivery times: 2–5 days within Belgium, 5–10 days within EU, up to 20 days internationally.

• Shipping costs are displayed at checkout.

• Risk transfers to the customer once delivery is confirmed by courier tracking.

10. Liability

• Necros is not liable for allergic reactions, skin sensitivities, or misuse.

• All ingredients are listed in INCI format; customers are responsible for reviewing allergens.

• Liability is limited to the value of the purchased product.

11. Governing Law & Jurisdiction

These Terms are governed by Belgian law and applicable EU legislation. Any disputes shall be resolved by the competent courts of Belgium.
